Отличителност на триизмерни марки в Испания ( Distinctness of the three-dimensional marks in Spain)

Интересно дело от Испания относно триизмерна търговска марка.
Freixenet е компания, която произвежда и дистрибутира CAVA (Испанско пенливо вино подобно на Шампанско). Преди време компанията завежда съдебни дела срещу Arvicaretey SA и Vid Vica SL с обвинението, че последните продават CAVA в бутилки имитиращи триизмерна марка на Freixenet, която се състой от бяла полупрозрачна заскрежена бутилка придружена от графични обекти.
През 2005 година the Barcelona Court of Appeal потвърждава решението на първоинстанционният съд, с което се отхвърлят обвиненията на Freixenet за нарушаване на права върху търговска марка, тъй като използваната от Arvicaretey SA и Vid Vica SL бутилка е само една част от марката на Freixenet. Според съдът когато се разглеждат случаи на нарушаване на марки, то те се преценяват в тяхната цялост.
При обжалването the High Court ревизира решението на the Barcelona Court of Appeal. Според съдът въпреки, че бутилката е само една част от марката на Freixenet, характера на марката се определя именно от отличителността на заскрежената бутилка придобила известност благодарение на масирана маркетингова кампания без да има използване на подобна бутилка сама по себе си.
Освен това съдът приел предоставените от Freixenet доказателства, които показвали че 70% от потребителите и търговските структури свързвали заскрежената бутилка с продукта CAVA произвеждан от Freixenet.

Interesting Case of Spain concerning the three-dimensional trademark.
Freixenet is a company that manufactured and distributed CAVA (Spanish sparkling wine like Champagne). A few years ago the company brought lawsuits against Arvicaretey SA and Vid Vica SL with the prosecution that the latter sold CAVA in bottles such as three-dimensional mark of Freixenet, which consisted of a white translucent frosted glass bottle complemented with several graphic and denominative elements.
In 2005 the Barcelona Court of Appeal confirmed the decision of the Court, which rejected the accusations of Freixenet for breach of trademark rights, as used by Arvicaretey SA and Vid Vica SL bottle is only one part of the Freixenet mark. According to the court when it considered the case of infringement of trade marks, they are judged in their entirety.
In the appeal the High Court reviewed the decision of the Barcelona Court of Appeal. According to court even though the bottle is only one part of the brand of Freixenet, the nature of the mark is determined by the particular distinctness of frosted bottle acquired fame thanks to a massive marketing campaign without the use of this bottle itself.
Furthermore, the court accepted the evidence provided by Freixenet, which show that 70 percent of consumer and commercial structures associated frosted bottle with CAVA product produced by Freixenet.
