Защита на нерегистриран дизайн в Ирландия ( Protection of unregistered design in Ireland)

Както е известно има две основни възможности за защита на дизайн на Общността, едната е неговата регистрация, другата е основана на правото в EU Community Designs Regulation (6/2002) за защита на нерегистриран дизайн в срок от три години.
Наскоро излезе решение на съд в Ирландия относно приложението на горното право.
Karen Millen е известна дизайнерска къща в Ирландия. Dunnes Stores е голяма верига от магазини за дрехи в страната.
Karen Millen започва да съди Dunnes Stores за нарушаване на права върху дизайн, тъй като последният е копирал дизайна на някои дрехи от колекцията на Karen Millen.
Dunnes Stores признават, че са копирали част от кройките на Karen Millen но не са съгласни с факта, че нарушават права на индустриална собственост.
The Commercial Court излезе с решение по това дело. Според съдът Karen Millen притежава права върху дизайна на дрехите от колекцията си. От своя страна Dunnes Stores не са убедили съдът, че Karen Millen е копирала кройката на моделите си от предишни колекции на Paul Smith и Dolce & Gabbana, тоест претенцията за дизайн е била неоснователна, поради неспазване на критерият за новост.
Съдът счита че моделите на дрехите на Karen Millen са защитими, като нерегистриран европейски дизайн, поради което осъжда Dunnes Stores, който трябва да предостави баланс на печалбата от продажбите си, както и да предаде всички продукти нарушаващи дизайна на дрехите на Karen Millen.

There are two main options for the protection of the Community design, one registration, the other is based on the law of the EU Community Designs Regulation (6 / 2002) to protect an unregistered design within three years.
