Изследване на правото и практиката относно търговските марки и дизайни от страна на SCT ( SCT study on the law and practice on trademarks and designs)

Приключи срещата на WIPO’s Standing Committee on Trademarks, Industrial Designs and Geographical Indications (SCT) от 22 до 26 юни 2009 година. Предмет на срещата беше изследване на изготвените доклади относно правото касаещо търговските марки и дизайните и възможните области на сближаване с практиката.
Докладите са:
- Possible convergence in industrial design law and practice;
- Grounds for refusal of all types of marks;
-Technical and procedural aspects of the registration of certification and collective marks;

Работата по тях ще продължи на следващата среща на SCT през ноември 2009 година.
SCT също обърна внимание на вече взето решение от the Paris Union Assembly през 2008 година за създаване на нова електронна база данни със защитените държавни символи и емблеми според член 6-ter на Парижката конвенция.
Член 6, трето
(1) а. Държавите - членки на Съюза, се споразумяват, че ще отказват и обезсилват
регистрацията и ще запрещават със съответни марки ползуването - без разрешение на
компетентните власти, било на фабрични или търговски марки, било като техни елементи, на
гербовете, знамената и други емблеми на държавите - членки на Съюза, както и на
официалните знаци за контрол и гаранция, приети от тях. Задължението обхваща и имитация
от гледна точка на хералдиката.
b. Разпорежданията на точка "а", по-горе, се прилагат също така и по отношение на гербовете,
знамената и други емблеми, сигли и наименования на международни междуправителствени
организации, в които една или повече от държавите - членки на Съюза, са членове, с
изключение на гербовете, знамената и други емблеми, сигли или наименования, които са били
вече обект на международни споразумения и са в сила, целещи да осигурят тяхната закрила.
с. Никоя страна - членка на Съюза, не е задължена да прилага разпоредбите, дадени в буква
"b", по-горе, във вреда на носителите на права, придобити добросъвестно, преди влизането в
сила в тази страна на настоящата Конвенция. Страните - членки на Съюза, не са задължени да
прилагат казаните разпоредби, когато ползуването или регистрацията, визирани в буква "а", по-
горе, не са от естество да предизвикат у публиката идеята за връзка между въпросната
организация и гербовете, знамената, емблемите, сиглите или наименованията - или ако
ползуването или регистрацията по всяка вероятност не са от естество да заблудят публиката
върху съществуванието на връзка между ползувателя и организацията.

The meeting of WIPO's Standing Committee on Trademarks, Industrial Designs and Geographical Indications (SCT) from 22 to 26 June, 2009 was closed. The purpose of the meeting was reports have prepared on the law concerning trademarks and designs and possible areas of convergence with practice.
The reports are:
- Possible convergence in industrial design law and practice;
- Grounds for refusal of all types of marks;
-Technical and procedural aspects of the registration of certification and collective marks;

Work will continue on the next meeting of the SCT in November 2009.
SCT also drew attention to the already decided by the Paris Union Assembly in 2008 to create a new electronic database of protected state emblems and symbols according to Article 6-ter of the Paris Convention.

art.6 ter Marks: Prohibitions concerning State Emblems, Official Hallmarks, and Emblems of Intergovernmental Organizations

(1)

(a) The countries of the Union agree to refuse or to invalidate the registration, and to prohibit by appropriate measures the use, without authorization by the competent authorities, either as trademarks or as elements of trademarks, of armorial bearings, flags, and other State emblems, of the countries of the Union, official signs and hallmarks indicating control and warranty adopted by them, and any imitation from a heraldic point of view.

(b) The provisions of subparagraph (a), above, shall apply equally to armorial bearings, flags, other emblems, abbreviations, and names, of international intergovernmental organizations of which one or more countries of the Union are members, with the exception of armorial bearings, flags, other emblems, abbreviations, and names, that are already the subject of international agreements in force, intended to ensure their protection.

(c) No country of the Union shall be required to apply the provisions of subparagraph (b), above, to the prejudice of the owners of rights acquired in good faith before the entry into force, in that country, of this Convention. The countries of the Union shall not be required to apply the said provisions when the use or registration referred to in subparagraph (a), above, is not of such a nature as to suggest to the public that a connection exists between the organization concerned and the armorial bearings, flags, emblems, abbreviations, and names, or if such use or registration is probably not of such a nature as to mislead the public as to the existence of a connection between the user and the organization.
