Спор за домейн roberto-cavalli-vodka.com ( Dispute for a roberto-cavalli-vodka.com)

Арбитражът на WIPO излезе с решение по спорът относно домейнът roberto-cavalli-vodka.com
Предисторията е следната:
Ищеца Roberto Cavalli S.p.A е италианска компания, която произвежда скъпи дрехи и аксесоари от 1978 година насам.
От 2006 година компанията започва да продава и собствена серия от алкохолни напитки включително и водка.
Roberto Cavalli S.p.A притежава редица регистрирани търговски марки по целият свят. Освен това компанията притежава серия от сайтове в това число и сайт “www.robertocavallivodka.com” на различни езици- италиански, руски, английски, немски. Спорният домейн roberto-cavalli-vodka.com е регистриран през 2007 година и се различава от този притежание на Roberto Cavalli S.p.A само по наличието на тире между думите.
Обвиняемото лице чието притежание е въпросният сайт го използва за реклама на различни барове и ресторанти в Германия и Австрия предлагащи продуктът ROBERTO CAVALLI Vodka.
От информация в сайта се разбира, че вносител на водката е компанията Krug Investment & Distribution, Германия.
В регистрацията на спорният домейн е посочен e-mail kruginvest.com.
Според Roberto Cavalli S.p.A те нямат директни отношения с Krug Investment & Distribution относно дистрибуцията на продуктът водка. Въпреки това обаче италианците признават, че немският дистрибутор има подписано споразумение с техен дистрибутор Tuscany S.r.l. с което на Krug Investment & Distribution се позволява разпространението на ROBERTO CAVALLI Vodka в Германия, Австрия и България.
В споразумението е записано че Krug Investment могат да използват марката ROBERTO CAVALLI за рекламни и комуникационни цели единствено с изричното писмено съгласие на Tuscany S.r.l.
Горното споразумение е било прекратено през 2007 година.
Според решението на арбитражът на WIPO немският дистрибутор не е имал право да регистрира объркващо сходен домейн без изричното съгласие на Roberto Cavalli S.p.A.
Поради това отсъжда прехвърляне на спорният домейн roberto-cavalli-vodka.com на италианската компания.

The history is as follows:
Plaintiff, Roberto Cavalli SpA is an Italian company that manufactures luxury clothes and accessories since 1978.
Since 2006 the company started to sell a number of alcoholic drinks including vodka.
Roberto Cavalli SpA has registered trademarks worldwide. Furthermore, the company owns a number of sites including the site "www.robertocavallivodka.com" in different languages, Italian, Russian, English, German. The controversial domain roberto-cavalli-vodka.com is registered in 2007 and differs from that owned by Roberto Cavalli SpA only in the presence of the hyphens between the words.
Accused person whose possession this site is use it for advertising various bars and restaurants in Germany and Austria offered ROBERTO CAVALLI Vodka.
An information on the site means that importers of vodka is the company Krug Investment & Distribution, Germany.
In the registration of controversial domain is specified e-mail kruginvest.com.
Roberto Cavalli SpA argue that they have no direct relationship with the Krug Investment & Distribution on the product distribution of vodka.
