Според съдът ако използването е до 30 секунди и неговата цел е да представи на потребителите песента преди закупуване, то за подобно представяне не се дължи заплащане на права.

The Society of Composers, Authors and Music Publishers of Canada (SOCAN) е на противоположното мнение, като счита че за такова използване също трябва да се заплащат отчисления.
Според The Federal Court of Appeals обаче такова използване влиза в обхвата на изключенията предвидени в законодателството относно авторските права. Едно от тези изключения е че авторско произведение може да бъде използвано в случайте касаещи изследователски проучвания. Според съда този казус засяга това изключение. Потребителите прослушват кратката 30 секундна версия на песента с цел за проучат дали тя отговаря на техните изисквания. Това може да се класифицира именно като изследване.
Според запознати това не е краят на историята, тъй като подобен казус в още по-големи мащаби може да възникне и в САЩ.

The Canadian Federal Court of Appeals issued a decision in the dispute about whether the use of shorter songs to be paid money to copyright and related rights or not.
The answer is NO.
According to court if they use up to 30 seconds and its purpose is to present the song before consumers purchase it, such a presentation is not subject to payment of royalties .
The Copyright Board of Canada issued the same decision in 2009.
The Society of Composers, Authors and Music Publishers of Canada (SOCAN) is the opposite opinion considering that for such use must also be paid royalties .
According to The Federal Court of Appeals, however, that use is covered by the exceptions provided in the legislation on copyright. One of those exceptions is that the author's work may be used in cases relating to research studies. According to the court this case concerns that exception. Users listen 30 seconds shorter version of the song in order to examine whether it meets their requirements. This can be classified as a particular study.
According to the familiar this is not the end of the story since such a case even larger scale may occur in the U.S..
