ALTEC LANSING fight for its brand in Switzerland - ALTEC LANSING се пребори за марката си в Швейцария

Компанията за озвучителна техника ALTEC LANSING успя да се пребори за регистрация на своята марка ALTEC LANSING в Швейцария.
Първоначално Патентното ведомство на Швейцария отказва да регистрира марката освен ако тя не бъде ограничена само за продукти произхождащи от САЩ. Според Патентното ведомство това се налага тъй като LANSING е столицата на щата Мичигън.
Доводите на ведомството реално се основават на забраната за регистрация на географски имена, като търговски марки освен ако се докаже, че в съответното географско място е невъзможно производството или предлагането на съответните стоки или услуги.
В конкретният случай производството на озвучителна техника е напълно реално в град LANSING, щата Мичигън.
Компанията обжалва решението.
The Federal Administrative Court преразглежда решението на Патентното ведомство и решава, че ALTEC LANSING може да бъде търговска марка в Швейцария. Доводите за това са че наименованието LANSING е слабо разпространено в Швейцария. За последните 4 години то е споменато една 123 пъти в пресата в страната. Освен това LANSING е фамилия и на човек. Като се добави, че марката се състой и от първа част ALTEC, която придава фантазиен характер, то вероятността потребителите да бъдат заблудени за географския произход на стоките не съществува.
Това решение може да се обжалва от Патентното ведомство пред Върховния съд.

The mark consists of the first part ALTEC, which gives fanciful character, so that consumers can not be misled about the geographical origin of goods.
This decision may be appealed by the Patent Office to the Supreme Court.
