Pacificor купува Терминатор


Cinema Newswalker съобщава новината за покупко-продажбата на правата върху едно от най-известните филмови заглавия Терминатор.
Новият собственик на правата е Pacificor, след борба с Лайънсгейт и Сони Пикчърс.
Срещу 29.5 милиона долара установената в Санта Барбара компания спечели проведения в Лос Анджелис търг. Освен тази сума бившите вече собственици от Хелсиън груп ще получат 5 милиона долара за всеки нов филм, който ще бъде правен от тук насетне, както и допълнителни приходи от използването на третата и четвъртата част от поредицата.

WIPO съобщава новината за присъединяването на Латвия към the Patent Law Treaty от Женева.
Договорът ще влезе в сила за Латвия от 12 юни 2010 година.

Метро Голдуин Майър с нов собственик?


Cinema Newswalker съобщава новината за евентуалната продажба на една от основните холивудски филмови компании Метро Голдуин Майър.
Според новината въпреки, че от студиото не разкриват имената на кандидат купувачите, то според добре осведомени източници предложенията са отправени от Аксес Индъстри (Access Industries), Лайънсгейт (Lionsgate) и Тайм Уорнър (Time Warner).
Както е известн МГМ притежава една от най- богатите библиотеки от филмови заглавия. Ако компанията не бъде продадена на парче, то се предполага, че новият собственик на студиото ще има възможността да се възползва, както от старите заглавия, така и от бъдещите печалбите от продукции като двете части на "Хобитът" и предстоящите филми за Джеймс Бонд.
Тази новина е интересна и с оглед на интелектуалната собственост. Безспорно Метро Голдуин Майър притежава достатъчно филмови заглавия, тоест авторски и сродни права, които могат да се окажат златна мина за бъдещите собственици.

The UK Pirate Party's излезе с манифест - The UK Pirate Party's published a manifesto


The UK Pirate Party's публикува манифест касаещ авторските права и патентите.
Манифеста е:

"Copyright and Patents
Our copyright law is hopelessly out of date. The Pirate Party wants a fair and balanced copyright law that is suitable for the 21st century.

Copyright should give artists the right to be the only people making money from their work, but that needs to be balanced with 'fair use' rights for the public. We will legalise use of copyright works where no money changes hands, which will give the public new rights;

A new right to format shift (for example, buy a CD then copy it to an iPod - which is currently illegal);
A new right to time shift (record a TV programme for watching later) and
A new right to share files (which provides free advertising that is essential for less-well-known artists).
Counterfeiting, and profiting directly from other people's work without paying them, will remain illegal.

When copyright was first introduced, the government decided it should protect new works for 14 years. Ever since then, lobbyists have spent huge sums of money buying longer and longer extensions to copyright. Currently copyright carries on for more than 70 years after the author of a work dies. We want to speak up for the majority of people who believe that taking money from lobbyists in return for biased laws is wrong. We believe that in this fast moving world, 10 years of copyright protection is long enough. Shorter copyright will encourage artists to keep on creating new work, will allow new art forms (such as mash-ups) and will stop big businesses from constantly reselling content we have already paid for. Our 10 year copyright length will include a renewal after 5 years (allowing works that the creator is no longer interested in to fall into the public domain after 5 years). An exception will be made for software, where a 5 year term will apply to closed source software, and a 10 year term to open source, in recognition of the extra rights given to the public by open source licences. We will remove the loophole in copyright law that allows 'restarting the clock' by simply moving content to a new format, or making a small change to it.

We also recognise the need to warn the public about Digital Restrictions Management (DRM) technology. We believe the public needs to be protected from products that can be remotely turned off by the manufacturer, or products that 'phone home' and would therefore stop working if the manufacturer went bankrupt, or that are 'region coded'. We will therefore introduce a mandatory warning label on products that include DRM which will warn purchasers of the defects built into these products. We also pledge not to introduce any new blank media taxes.

We believe that patents exist to reward the inventors of truly outstanding ideas, not to allow big businesses to stifle competition with an ever-growing tide of trivial, incomprehensible, overreaching patents. We will stop the abuse of patent law by raising the bar on how innovative an idea has to be before it can be patented, and by prohibiting patents on software, business methods, concepts, colours and smells. We will require a working model to be provided to the patent office before a patent is granted, and we will strictly enforce the current rule that patents are invalid if they are "obvious to someone skilled in the art". We will allow more competition in the manufacturing of patented devices by introducing a system of compulsory patent licensing, and we will provide exemptions to patent law for non-commercial use, personal study and academic research.

Pharmaceutical patents are a major problem for the world. We need to strike a better balance between the need to pay for drug research, and the need to end the postcode lottery that UK citizens suffer when patented drugs are too expensive for the NHS. We need to tackle the problem of preventable deaths in the third world caused by high price of patented drugs. We will achieve this by abolishing drug patents, which will reduce drug costs drastically, since all drugs will become generic. This will save the NHS a massive amount of money, and part of that saving will be used to subsidise drug research. The pharmaceutical industry currently spends around 15% of its patent drug income on research; we will replace that with subsidies to the value of 20%, increasing research budgets, while still saving the NHS money. This policy of making all drugs generic will create a massive opportunity for industry to make profits, employ more people, and save lives by encouraging the manufacturing newly generic drugs in this country for sale to the third world.

Government copyrights are increasingly becoming a problem for society, with data such as maps and postcodes being jealously protected by government departments. We will introduce a new right of access to government funded data, requiring the release of all maps, statistics and so on that have been paid for by the taxpayer in open formats, under a Creative Commons or similar licence, giving the public access to research that they have already paid for. An exception will be made for cases that genuinely have national security or privacy concerns. This will include the output of the BBC, which is funded by the licence paying public and should therefore belong to the licence paying public. We will amend the BBC's charter to prevent the BBC from using DRM technology, and to require the BBC to release all their content under a Creative Commons licence. We pledge to maintain and expand the current list of important national events that cannot be exclusively broadcast pay TV services, and we pledge to put into action the government's existing but widely ignored Open Source Action Plan, which would encourage the use of free software in the public sector, saving money, and making the UK less reliant on foreign software suppliers".
В интерес на истината някои от идейте и заключенията изложени в манифеста са резонни с оглед развитието на обществото и технологиите.
Факт е че законодателството обикновенно изостава от развитието на практиката в областта на технологиите и конкретно при защитата на авторските права. От тази гледна точка е необходим широк обществен дебат не само във Велокобритания но и в ЕС.

По-малко международни марки през 2009 година - Less international brands in 2009


WIPO публикува информация относно заявените и регистрирани международни марки през 2009 година.
Според данните през 2009 година е отбелязан спад от 16% на заявените международни марки и 12% спад при регистрираните марки.
Според WIPO причина за това е глобалната икономическа криза. Поради намаленото потребление компаниите са намалили въвеждането на нови продукти на пазара, което от своя страна е довело и до намаляване на броят на търговските марки.
Най-големият заявител на международни марки през 2009 година е била швейцарската компания Novartis с 136 заявки. На второ място е Lidl ( Германия) , а на трето място е Henkel (Германия).
Държавите които са били най-често посочвани в заявките за международни марки са: Китай, Русия, САЩ, Швейцария, ЕС и Япония.

WIPO publishes information concerning the claimed and registered international trademarks in 2009.
According to the data there was a decrease of 16% of requested international marks and 12% decline in registered trade marks in 2009
According to WIPO the reason for this is the global economic crisis. Due to reduced consumption, companies are reducing the introduction of new products, which in turn has led to a reduction in the number of trademarks.
The largest applicant for international marks in 2009 was the Swiss company Novartis by 136
applications. Secondly it is Lidl (Germany) and thirdly is Henkel (Germany).
Countries that were most frequently cited in
applications for international trademaks are: China, Russia, USA, Switzerland, EU and Japan.

Microsoft fined with 105 million dollars - Глобяват Microsoft с 105 милиона долара


Philip Brooks' Patent Infringement Updates съобщава новината, че Microsoft е глобена с 105 милиона долара. Това се е случило след загубено съдебно дело повдигнато от калифорнийската компания VirnetX Holding Corporation. Според обвинението Microsoft са нарушили два патента за методи касаещи система за сигурност във виртуална частна мрежа ( VPN).
Според решението на съдът Microsoft ще заплатят обезщетение от 71 милиона долара за нарушаването на първият патент и 34 милиона долара за нарушаването на вторият патент.

Philip Brooks' Patent Infringement Updates reported the news that Microsoft was fined 105 million dollars. This happened after losing a court case raised by the California company VirnetX Holding Corporation. According to the indictment Microsoft had infringed two patents related to methods for security system in a virtual private network (VPN).
According to the decision of the court, Microsoft will pay a compensation of 71 million dollars for violating the first patent and 34 million dollars for violations of the second patent.

Обявени са номинациите за Европейски изобретател на годината 2010


Новина от Патентно ведомство:

На 28 април 2010 г. в Мадрид, в рамките на Европейския патентен форум 2010, за пета поредна година ще се проведе церемонията по връчване на наградите “Европейски изобретател на годината”. Европейското патентно ведомство (ЕПВ) и Европейската комисия (ЕК) обявиха 12-те номинирани за 2010 г., които се състезават в четири категории – промишленост, малки и средни предприятия /научни изследвания, неевропейски държави и цялостна изобретателска дейност. Наградата, която се връчва, е напълно символична и няма материално изражение. Тя се присъжда на индивидуални изобретатели или творчески екипи от изобретатели, които със своята пионерска дейност дават отговори на предизвикателствата на нашето време и по този начин допринасят за прогреса и напредъка на Европа и света. Наградите ще бъдат връчени от президента на Европейското патентно ведомство Алисън Бримлоу.
Тазгодишните номинации включват изобретатели от различни области - от икономията на питейна вода до синтеза на молекули карбон с формата на футболна топка, от лечението на рак до криптирането на дигитални данни. Сред номинациите са и такива, отнасящи се до технически иновации, които са допринесли за успеха на Wii конзолата и за гражданската употреба на GPS-системите, до зашеметяващото изследване на мобилната употреба на горивните клетки, „еко”-пластмасата и достъпа до интернет, директно през електрически контакт на стената. Canon wants to have its own top level domain - Canon иска да има собствен домейн от първо ниво


Slaw.ca съобщава новината, че Canon ще поискат от ICANN собствен домейн от първо ниво .cannon. Това се очаква да стане през тази година след, като ICANN вече взе решение че всеки който желае ще може да регистрира домейни от първо ниво. Това обаче ще бъде доста скъпо удоволствие около 185 000 долара.
От Canon считат, че по този начин ще осигурят и защитят по-добре позициите си в интернет пространството и ще подобрят online комуникацията с потребителите си.

A statistics from Germany concerning trademarks - Статистика от Германия относно търговски марки


Патентното ведомство на Германия публикува статистическа информация относно търговските марки в страната.
Според информацията през 2009 година в Германия са били заявени 69 069 търговски марки, което е с 6,5% по-малки в сравнение с 2008 година.
Броят на регистрираните марки през 2009 година в Германия е 49 817.
Най-много заявени марки има от провинция North Rhine-Westphalia.

Germany's Patent Office publishes statistics on trade marks in the country.

A decision of the European Court on three-dimensional mark - Решение на Европейският съд относно триизмерни марки

Случаят касае спор относно триизмерни марки за форма на бутилки.
Weldebräu GmbH & Co. KG притежава регистрирана европейска марка за форма на зелена бутилка.
Чешката компания Kofola Holding a.s. заявява, като европейска марка сходна форма на бутилка без цвят.

Weldebräu GmbH подава опозиция с твърдението, че двете марки са сходни. OHIM отхвърля опозицията с твърдението, че поради отличителността на по-ранната марка не е възможно да има наличие на объркване в потребителите по отношение на двете марки.
The General Court се съгласява с това решение на OHIM.
Според съдът въпреки, че на бутилката на Kofola Holding заявена, като марка е изписано
‘snipp’, то е прозрачно, като бутилката и поради това не може да отличи марката но:

26 От една страна, в очите на средните потребители, относително осведомени и в разумни граници наблюдателни и съобразителни, по-ранният знак изглежда по-дълъг, по-тънък и следователно по-деликатен от заявения знак, който има по-малко, плътно и едро очертание, създаващо впечатление за тромавост. Освен това формата на тялото на бутилката на заявения знак е неправилна поради превитата ѝ част, докато тази на по-ранния знак е права. От друга страна, следва да се посочи, че гърлата, въпреки че и двете са спираловидни, представляват различни спирали. Докато гърлото на по-ранния знак е по-тънко и съставено само от две завъртания, гърлото на заявения знак изглежда по-плътно и съставено от поне четири завъртания.

27 Следователно апелативният състав не е допуснал грешка, като е приел в точка 31 от обжалваното решение, че фактът, че гърлото на двете бутилки може да бъде описано като такова „със спираловидна форма“, има само малко значение предвид големите разлики, съществуващи между формите на двете гърла.

31 В конкретния случай в точка 24 от обжалваното решение апелативният състав приема, че по-ранната марка има средно отличителен характер. Жалбоподателят не оспорва това съображение, но твърди, че посочената марка притежава такъв характер най-малко поради уникалния и необичайния ѝ външен вид, признат по-специално от различни награди, получени поради своеобразието на бутилката. От друга страна, е важно да се посочи, както това прави апелативният състав, че жалбоподателят не е представил нито един довод, който да доказва, че марката му е п ридобила отличителен характер поради интензивно използване или поради репутацията ѝ.

32 Доколкото между конфликтните знаци има значителни разлики и доколкото жалбоподателят не е доказал в какво се изразява високо отличителният характер на по-ранната марка, единствено фактът, че двете бутилки имат гърла със спираловидна форма, не позволява да се направи извод, че съществува вероятност от объркване между конфликтните марки въпреки идентичността на съответните стоки.

33 Този извод не може да се постави под съмнение от довода на жалбоподателя, според който в конкретния случай впечатлението от конфликтните марки при допир има значителна роля. Всъщност, както правилно посочва СХВП, от начините на продажба на бутилките, а именно от присъствието им като етикетирани стоки на щандовете за хранителни стоки на универсалните магазини или от поръчването им в бар или ресторант, следва, че потребителят ще се концентрира предварително и основно върху словните и фигуративни елементи, посочени върху етикетите им, като наименованието на марката, логото и/или други фигуративни елементи, които указват произхода на стоката.

The case concerns a dispute concerning the three-dimensional trademarks for bottles.
Weldebräu GmbH & Co. KG has a registered trade mark for a European mark for a green bottle.
Czech Kofola Holding company makes an application for similar shape of bottle, no color.
Weldebräu GmbH filed opposition, arguing that the two marks are similar. OHIM rejected the opposition, claiming that because of distinctiveness of the earlier mark is not likely to be available a consumer confusion regarding the two brands.
The General Court agrees with the decision of the OHIM.
According to the court, although the bottle of Kofola Holding has engraved 'snipp', it is transparent, as the bottle, and therefore can not distinguish the brand but:
26 First, the earlier sign appears, from the perspective of average consumers who are reasonably well informed and reasonably observant and circumspect, to be longer, slimmer and therefore more delicate than the sign applied for, which has a smaller, thicker and more corpulent silhouette which gives a more bulky impression. In addition, in the case of the sign applied for the shape of the body of the bottle is irregular because of its curvy form, whereas that of the earlier sign is straight. Secondly, the necks, although both helical, have different spirals. Whereas the neck of the earlier sign is thinner and consists of only two helical turns, that of the sign applied for is wider and consists of at least four helical turns.

27 Consequently, the Board of Appeal did not err when it found, in paragraph 31 of the contested decision, that the fact that the neck of both bottles can be described as ‘helical-shaped’ is of very little relevance, as the shape of each neck is very different.

31 In the present case, the Board of Appeal found, in paragraph 24 of the contested decision, that the earlier mark had an average degree of distinctiveness. The applicant does not dispute that finding, although it submits that that mark has at least that average degree of distinctiveness because of its unique and unusual appearance, confirmed by the various prizes received for the special design of the bottle. In any event, as the Board of Appeal noted, the applicant has not submitted any argument proving that its mark has acquired distinctiveness by virtue of intensive use or its reputation.

32 Since the signs at issue have significant differences and the applicant has not demonstrated in what way the earlier mark is highly distinctive, the mere fact that the two bottles have a helically formed neck does not lead to the conclusion that there is a likelihood of confusion between the marks at issue, despite the fact that the goods at issue are identical.

33 That conclusion is not affected by the applicant’s argument that the tactile impression of the marks at issue plays an important role in the present case. As OHIM correctly points out, the selling arrangements for the bottles – namely their display as labelled goods in the food aisles of supermarkets or their being ordered in a bar or restaurant – mean that prior to purchase the consumer will concentrate mainly on the word and figurative elements on their labels, such as the trade mark’s name, logo and/or other figurative elements indicating the product’s origin.

Европейското патентно ведомство има нов президент


Новина от Патентно ведомство:
"Административният съвет на Европейската патентна организация избра французина Беноа Батистели за президент на Европейското патентно ведомство на заседанието си, провело се на 1 март 2010 г. На 1 юли тази година той ще поеме поста за следващите пет години от настоящия президент, англичанката Алисън Бримлоу. В момента Беноа Батистели е генерален директор на Френския национален институт за индустриална собственост. Беноа Батсители бе избран за президент на Европейското патентно ведомство съгласно правилата на избора, които изискват квалифицирано мнозинство от три четвърти от гласовете на страните - членки на Организацията."

Датското патентно ведомство подкрепи ведомствата на Бенелюкс и Унгария - Danish Patent Office support the Benelux and Hungary patent offices


Патентното ведомство на Дания излезе със становище, което подкрепя мнението на ведомствата на Бенелюкс и Унгария относно спорният въпрос за това в колко държави трябва да се използва една европейска марка за да се счете, че е използвана реално и в достатъчна степен.
Становището на Ведомството е:

"When assessing the functioning of the present European trademark system, one should look at the reasons why this system was created, and the considerations behind its establishment. The Council regulation on the Community trademark mentions that one of the purposes of the CTM is to promote throughout the Community a harmonious development of economic activities and a continuous and balanced expansion by completing an internal market which functions properly and offers conditions which are similar to those obtaining in a national market. This also shows that the EU Council has made a distinctly political decision that we should uphold two parallel trademark systems in Europe; one national and one regional access to trademark registration.

One could question of course to what extend a European trademark should be used and in how many countries such a use should be required. This is not an easy question to answer. However, it is the DKPTO’s point of view that use in a very limited part of the Community seems not to fulfill the purpose and the intentions of the European trademark regulation. On the other hand, it seems too restrictive to demand that the European trademark is used in all 27 member states. The answer must lie somewhere in the middle.

Another aspect which could be mentioned in this context is that we see a tendency towards an increase in the number of registered trademarks, and it should of course be examined whether and if this poses a problem for the continued functioning of the European trademark system. e-Book бъдещето на книгите или не - e-Book the future of books or


Neil Wilkof публикува интересна статия в IP Finance относно все по-модерното разпространение на книги on-line или така наречените e-books.
Дали този нов начин на дистрибуция и потребяване на книги е бъдещето на книгоразпространението или не?
Този въпрос стана изключително актуален особено напоследък. Причина за това е от една страна масираната кампания на Google за създаването на гигантска on-line библиотека, а от друга появата на леки преносими устройства за съхраняване и четене на документи, като iPad и др.
Навлизането на e-books, при равни и други условия, би трябвало да намали значително цената на книгите, тъй като разходите по отпечатване, използване на печатници, хартия, дистрибуция и тн. ще се намалят значително.
Това би било така обаче при равни и други условия. В момента цената на стандартната книга от хартия се определя от различни фактори, като цената на хартията, стойността на отпечатването, разходите по дистрибуция, възнагражденията за авторски права и тн. Дори да приемем, че част от тези разходи биха били намалени то цената на една книга се определя и от това каква печалба биха поискали да имат издателите и каква печалба биха поискали авторите при положение, че e-books ще могат да се разпространяват реално по целият свят за отрицателно време.

Neil Wilkof published an interesting article in IP Finance concerning a more modern distribution of books on-line or so called e-books.
Is this new way of distribution and consumption of books is the future of the distribution of books or not?
This issue became particularly relevant especially lately. The reason on one hand is a massive campaign of Google to create a giant on-line library, on the other the emergence of light portable devices for storing and reading documents, etc. iPad.
A penetration of e-books should significantly reduce the cost of books, since the cost of printing, use of printers, paper, distribution and so on. will be substantially reduced.
Is this so in reality. The price of a standard book of paper is determined by various factors such as the cost of the paper, the value of printing, distribution costs, royalties and so on. Even assuming that some of these costs would be reduced then the price of a book is determined by what margin will ask publishers and what will be the profits of authors, provided that e-books will be distributed on the whole real world.

RapidShare is threatened by new fines - RapidShare заплашена от нови глоби


IPKat съобщава новината, че P2P сайтът RapidShare е заплашен от нови многомилионни глоби.
Съдът в Хамбург, Германия осъди компанията през 2009 година да заплати 24 милиона евро обезщетение за нарушаване на авторски и сродни права върху над 5000 музикални произведения разпространявани през сайтът.
Сега редица продуценти и издатели, като John Wiley, Cengage и McGraw-Hill изискаха от съдът RapidSaher да спре разпространението на 148 авторски творби.
Според съдът компанията трябва да наблюдава какво потребителите й качват, като съдържание и да предотвратява такова, което нарушава авторски и сродни права.
Новата глоба която грози RapidShare е между 250 000 и 7,2 милиона евро.

IPKat reports that the P2P site RapidShare is threatened by new multimillion fines.
The court in Hamburg, Germany condemned the company in 2009 to pay 24 million euros damages for breach of copyright and related rights on more than 5000 songs distributed through the site.
Now many producers and publishers as John Wiley, Cengage McGraw-Hill and requested to the court, RapidSaher to stop the spread of 148 copyrighted works.
According to the court, the company must monitor what its users upload and to prevent violations of copyright and related rights.
The fine which threatens RapidShare is between 250 000 and 7.2 million euros.

Ferrari stops a Daimler's advertising - Ferrari спира реклама на Daimler


Marques Class 46 съобщава интересна новина за спречкване между Ferrari и Daimler.
Немският автомобилен производител Daimler стартира рекламна кампания на моделът си Smart.
В рекламният видео клип се прави връзка между луксозните двуместни спортни автомобили и Smart, който също е двуместна кола. За целта във видеото се показват спортни автомобили, като Lamborghini Gallardo, Porsche GT и Ferrari Enzo.
Отделът по интелектуална собственост на Ferrari, който е известен със сериозната си работа по защита на правата на компанията, естествено изпраща предупредително писмо до Daimler с искане за спиране на рекламата.

German carmaker Daimler launched an advertising campaign for its model Smart.

Slovenia protect it's salt cake as a traditional food in Europe - Словения защити своя солена торта, като традиционна храна в Европа


Словенската солена торта Belokranjska pogača получи закрила, като традиционна храна в Европа. Рецептурата на този продукт може да откриете тук.
Интересно е да бъде отбелязано, че страните от Централна и Източна Европа започват да регистрират все повече и повече географски означения и традиционни храни в Европа.
Може би това е един от начините за запазване на културната им идентичност в рамките на Европейския съюз. Естествено другата причина е чисто финансова.

The Netherlands and Ukraine joined to the Singapore Treaty - Холандия и Украйна се присъединиха към Сингапурският договор


WIPO съобщава новината за присъединяването на две нови държави - Холандия и Украйна към Сингапурският договор за търговски марки.
Договорът влиза в сила за Украйна от 24 май 2010 година.

The European Audiovisual Observatory е основана през 1992 година и има 36 държави членки, като целта на организацията е да подобри трансфера на информация и прозрачността на пазара на аудио-визуални произведения в Европа.
Областите в които организацията осъществява дейността си са: Филми, Телевизия, Видео/DVD и Нови медии.

Baidu loses a lawsuit in China - Глобяват Baidu в Китай


Китайската интернет търсачка Baidu загуби съдебно дело повдигнато от the Music Copyright Society Of China. Според обвинението Baidu е нямала разрешение да позволява свалянето на музика чрез сайтът си. От компанията се оправдали, че те само предоставят възможност за качване на линкове за сваляне на музика. Съдът признал Baidu за виновна тъй като освен линковете на страницата били публикувани и заглавията на песните, които били част от произведенията закриляни от авторското право в Китай.

Chinese search engine Baidu lost a lawsuit raised by the Music Copyright Society Of China. According to the indictment Baidu is not authorized to allow downloading of music via the site. The company justifies that it only provides the ability to upload links for downloading music. The court acknowledged Baidu guilty, because in addition to links on the site were published and the titles and lyrics of the songs that were part of the works protected by copyright law in China.
