Интелектуалната собственост и конквистадорите - Intellectual property and conquistadors

През 1591 година испанският конквистадор Juan Ramírez de Velasco решава на наименува регион в днешна Аржентина с името Todos los Santos de la Nueva Rioja в чест на родния си град в Испания La Rioja.
В момента в Аржентина съществува провинция наречена La Rioja, чиято столица носи същото име.
Дотук всичко е ясно но къде и връзката с интелектуалната собственост. Испанският град La Rioja е широко известен с червените си вина Tempranillo още от 1150 година. Проблемът е че през вековете в аржентинската провинция La Rioja също започва производството на вина, които естествено носят същото наименование.
Създаденият през 1926 година  Control Board for the Rioja Denomination of Origin (the Rioja Board) започва усилена борба против произвежданите в Аржентина вина носещи името La Rioja. В резултат на това аржентинското вино започва да носи наименованието La Rioja Argentina и се полза със закрила само, като географско указание.
Въпреки това обаче продължава да съществува объркване относно двете вина особено в развиващите се азиатски пазари.
The Rioja Board продължават с борбата си, като искат цялостно спиране на използването на името La Rioja. Съдът в Аржентина обаче отхвърля подобно искане, като счита наличието на уточнението Argentina за достатъчно отличаващо за вината произхождащи от тази държава.
Дали ситуацията щеше да бъде по-различна ако конквистадорите разбираха въпросите касаещи интелектуалната собственост?

In 1591 the Spanish conquistador Juan Ramírez de Velasco decided to name the region in Argentina  with the name of Todos los Santos de la Nueva Rioja in honor of his hometown in Spain La Rioja.Currently, there is a province in Argentina which is called La Rioja, whose capital bears the same name.
So far everything is clear but where the connection with intellectual property is. The Spanish city of La Rioja has been widely known for its red wines Tempranillo since 1150. The problem is that over the centuries the Argentine province of La Rioja has also started producing wines that naturally have the same name.

The Rioja Board continue to fight, now they want a complete ceasing of using the name La Rioja. The Court in Argentina, however, rejected such a request, considering the existence of clarification Argentina sufficiently characterized for wines originating from that country.
