Доматите не могат да бъдат промишлен дизайн в Европа - Tomatoes cannot be industrial design in Europe

Едно интересно решение на Апелативният борд на OHIM. Казусът касае опит за регистрация, като европейски дизайни на следната визия на домати за плодове и зеленчуци в клас 1-02 от Локарнската класификация:

OHIM отказва заявката с довод, че представените визии не отговарят на определението за дизайн.
Решението е обжалвано пред Апелативният борд.
Заявителят оспорва отказът, като заявява, че доматите са вид продукт, произведен в резултат на човешки усилия, като законодателството не забранява изрично регистрацията на живи обекти, като дизайн. Регистрацията касае само външният вид на продукта.
Според Борда живите организми не представляват продукти, тъй като те не са индустриален обект. Макар заявителят да твърди, че за тези вид домати притежава патент, това не означава, че те могат да бъдат обхванати от закрилата чрез индустриален дизайн.

An interesting decision by the Board of Appeal of OHIM. The case concerns the attempt for registration of European design for the following tomatoes visions for fruit and vegetables in class 1-02 from Locarno Classification :
OHIM refused the application on the grounds that this produts does not meet the definition of a design.The decision was appealed to the Board of Appeal.The applicant challenged the refusal, stating that tomatoes are a type of product produced as a result of human effort, and the law does not expressly prohibit the registration of live objects as design. Design registration concerns only the appearance of the product.According to the Board living organisms do not represent products as they are not industrial items. Although the applicant claims patent protection for these kind of tomatoes this does not mean that they can be covered by the protection of industrial designs.More information here.
