Игра на поло в Европейския съд - A polo game at the European Court

Европийският съд излезе с решение по дело T‑90/13. Делото касае опит на португалската компания Herdade de S. Tiago II — Sociedade Agrícola, SA да регистрира следната европейска марка за класове 3, 18, 25, 28, 41, 43:

Срещу тази марка е подадена опозиция от The Polo/Lauren Company LP на основата следните по-ранни марки в класове 9, 18, 20, 21, 24 и 25:

OHIM потвърждава опозицията за класове 25, 18 ( с изключение на "Камшици, хамути и сарашки стоки"), клас 28 
Европейският съд потвърждава решението на OHIM. Във визуално отношение и двете марки имат играч на поло, представен в процеса на играта. Макар да има някои разлики в представянето на марките, потребителите ще разпознаят ясно играча на поло, който е основният елемент в марките.

The European Court issued in case T‑90/13, which concerns an attempt of the Portuguese company
Herdade de S. Tiago II — Sociedade Agrícola, SA to register the following European trademark for Classes 3, 18, 25, 28, 41, 43:
Against this trademark was filled an opposition by  The Polo/Lauren Company LP on the basis of following earlier marks for Classes  9, 18, 20, 21, 24 и 25: 
OHIM partially upheld the opposition in Class 25q Class 18 (except "whips, harness and saddlery''), Class 28 (only for 'Games and Toys'), Class 3 (only for 'soaps, perfumery, essential oils, cosmetics, hair lotions ") and Class 41 (only for' sports activities, organizing exhibitions for sporting purposes; sporting activities, including the organization of sporting events ").
The European Court upheld this decision. At visual level both marks containing a polo player, represent in motion.  Although there are some differences in the representations, the consumers will distinguish the main element in the marks - the polo player as leading part.
