Официалният вестник на Европейския съюз публикува решението за регистрация на първото българско географско означение в Европа.
Това е Горнооряховски суджуд.
Решението може да откриете тук.
Повече информация за защитеното географско означение ( PGI) може да откриете тук.
По този начин България се нареди сред страните в Европа притежаващи защитени географски означения на континента.
Лидери по брой регистрации в това отношение са Франция, Италия, Испания.

The Journal of the European Union published a decision regarding the registration of the first Bulgarian geographical indication in Europe.
This is Gornooryahovski Sudzhuk.

Thus, Bulgaria is ranked among the European countries having geographical indications on the continent.
Leaders in this regard are France, Italy, Spain.

BT съди Google - BT filed a lawsuit against Google

Английският телекомуникационен доставчик BT заведе съдебно дело срещу Google за нарушаване на техни патенти чрез използваната от Google платформа Android.
BT е поредната, компания завела съдебно дело относно Android.
Засегнатите патенти, касаят софтуер за навигация, персонален достъп до услуги и съдържание и тн.
Делото е заведено в САЩ, като за сега не е ясно дали подобно дело ще бъде започнато и в Великобритания.

The British telecoms provider BT filed a lawsuit against Google for violating of patents regarding Android.
BT is one of the latest companies which has filed a lawsuit concerning Android.
The affected patents pertain to navigation software, personal access to services and content and so on.
The lawsuit was filed in the U.S., for now it is unclear whether such action will be initiated in the UK.

The Patent Board (DIRPA) and the Department of Contracts, Records and Geographical Indications (DICIG) оповести новината, че въвежда нова номерация на патентите, дизайните и географските означения в Бразилия. Новата номерация ще отговаря на международните стандарти.
Промените влизат в сила от 02.01.2012 и се състоят в следното:

Новият модел на номерацията ще бъде:

BR ZZ XXXX YYYYYY K

където:

BR - означава Бразилия;
ZZ- означава вида на защитата;
XXXX- означава годината на заявката;
YYYYYY- означава номера на заявката;
K - означава номера на молбата;

The Patent Board (DIRPA) and the Department of Contracts, Records and Geographical Indications (DICIG) announced the news that introduces a new numbering concerning patents, designs and geographical indications in Brazil. The new numbers will meet international standards.
Changes take effect from 02.01.2012 and shall consist of the following:

The new numbering model will be:

BR ZZ XXXX YYYYYY K

where:

BR-will means Brazil;
ZZ- will means the type of protection;
XXXX- will means the year of application;
YYYYYY- will means the application number;
K - will means the number of the application;

Швейцарското си е швейцарско - Swiss and only Swiss

Европейският съд излезе с решение по дело T-377/09, с което потвърждава отказът на OHIM да регистрира марка PASSIONATELY SWISS за стоки и услуги в класове 16, 35, 41, 43 и 44.
Според съда марката съдържа индикация за произход и в същото време е описателна за качествата на посочените стоки и услуги. Смисълът на марката асоциира с категоричност касаеща швейцарският произход.
Освен това според потвърденото решение на OHIM марката има хвалебствен и промоционален характер, което е допълнителна предпоставка тя да не бъде допусната до регистрация.

The General Court ruled in Case T-377/09, confirming the refusal of OHIM to register a trade mark PASSIONATELY SWISS for goods and services in classes 16, 35, 41, 43 and 44.
According to the court the trademark contains an indication of origin and at the same time it is descriptive of the quality of the goods and services. The meaning of the brand associated with “strongly Swiss”, “extremely Swiss”, "resolutly Swiss" which refer to the Swiss origin.
Moreover, according to the OHIM decision this mark has laudatory and promotional nature which is an additional precondition that it should not be allowed to registration.

Променя в базата данни за марки на USPTO - Changes in the USPTO trademark database

Американското патентно ведомство обяви новината, че считано от 16 декември 2011 въвежда нова система Trademark Status and Document Retrieval (TSDR 1.0), касаеща базата данни за търговски марки, която ще замени настоящата.
Чрез новата система ще се предоставя пълна информация за регистрацията на една марка на едно място. Освен това ще бъдат въведени и нови функции, като:

• The ability to preview and print the status content being presented.
• The ability to download a PDF or the original form of the status content (an Extensible Markup Language (XML) file).
• The ability to view the mark as stored in the USPTO mark image repository, and expand the size thereof through mouse rollover feature.
• The organization of content into logical sections, with a more logical arrangement of the content within those sections.
• The ability to collapse and expand sections of the data.
• The ability to move easily between status and document content.
• The presentation of basis data at both the case and class levels.
• Links to related properties, where applicable.
• Access to Trademark status data without going to the TSDR site via an Application Programming Interface (API), which is accessible via unique URL’s that allow the retrieval of data in a specified format (PDF or XML).
• Significant decrease in the amount of time between an update to the internal USPTO database record and what is available externally (seconds as opposed to hours)

The U.S. Patent Office announced the news that a new system which is called Trademark Status and Document Retrieval (TSDR 1.0) concerning the trademark database will be introduced and replaced the current one. The new system comes into operation on December 16, 2011.
This new system will provide full information regarding the registration of a mark in one place. It will also be introduced and new features like:

Хърватска подписа договора за присъединяване към Европейския съюз. Той влиза в сила от 1.07.2013 година.
С присъединяването на страната, цялото законодателство на ЕС касаещо интелектуалната собственост ще бъде в сила и на нейна територия.
В частност регистрираните търговски марки и дизайни на Общността ще имат сила и на територията на Хърватска.

Croatia signed the Accession Treaty with the European Union. It entered into force on 1.07.2013 year.
With the accession of the country, all EU legislation concerning intellectual property will be in force in its territory.
In particular, registered trademarks and designs will be effective on the territory of Croatia.

Samsung загуби дело срещу Apple във Франция - Samsung loses a lawsuit against Apple in France

The Tribunal de Grande Instance de Paris излезе с решение по делото между Samsung и Apple, с което корейската компания искаше от съда да забрани продажбата на iPhone 4S във Франция.
Съдът отхвърля искането на Samsung, като неоснователно и им присъжда разходите по делото, които възлизат на около 100 000 евро.
В момента това решение се обжалва но според специалисти е много вероятно Samsung отново да загубят, тъй като законовите изисквания за подобни искания за забрана са много високи във Франция.
Това е поредното дело, което е част от глобалната IP война между двете компании за пазарното лидерство в сегмента на смарттелефоните и таблетите.
Като цяло към момента битката се води с променлив успех в различните държави по света с определен превес на Apple.

The Tribunal de Grande Instance de Paris issued a decision in the law case between Samsung and Apple in which the Korean company wants from the court to prohibit the sale of the iPhone 4S in France.
The court rejects this request of Samsung as disproportionate and awarded them costs of the case which amounted to € 100,000.
Currently this decision is being appealed but according to experts it is very likely that Samsung will lose it again because the legal standard for a preliminary injunction is reasonably high in France.
This is another case that is part of the global IP war between the two companies for market leadership in the segment of smartphones and tablets.
Overall, the battle is fought with varying success in different countries around the world with a certain preponderance of Apple.

Интересна новина от Швейцария. Търговец на месни продукти в страната започва да използва показаната визия за рекламно брандиране на ванове.
Рекламният слоган гласи: "Най-доброто месо в града".
Правителствената агенция отговаряща за рекламата в страната е сезирана веднага.
Според решението на Агенцията тази реклама е сексистка и обидна за жените. Поради това нейното използване трябва да бъде преустановено.

Interesting news from Switzerland. A manufacturer of meat products in the country had begun to use the displayed image for an advertisement by branding vans.
The advertising slogan reads: " best meat in town."
The government agency responsible for advertising matters in the country was approached on the matter immediately.
According to the Agency's decision this ad is sexist and offensive. Therefore, its use should be discontinued.
