Европейският съд излезе с решение по делото T-160/09 касаещо заявка за европейска марка OFTAL CUSI при наличие на по-ранна марка OPHTAL за стоки от клас 5- фармацефтични продукти за очи.
Според съда релевантната публика в случая се състой от професионалисти в областта на медицината, които са запознати в значителна степен с подобни лекарствени средства.
По-ранната марка е слабо отличителна, тъй като думата OPHTAL е сходна на ‘ophthal’, която произлиза от гръцката дума ophthalmòs, означаваща око.
По този начин съдът счита, че отличителния елемент в по-късната марка е думата CUSI, докато OFTAL също асоциира с характеристиката на стоките.
Доводът на заявителя на марката, че тя е част от фамилия марки TIM OPHTAL, TIM OPHTAL, LAC OPHTAL, не е приет от съда, който счита че отличителните елементи в тези марки са само думите TIM, TIM, LAC.

The European Court ruled in the case T-160/09 concerning the application for European trademark OFTAL CUSI in the presence of an earlier mark OPHTAL for goods in Class 5 - pharmaceutical products for eyes.
According to the court in this case the relevant public is consists of professionals in the medical field who are substantially familiar with similar drugs.
The earlier mark is indistinctive as the word OPHTAL is similar to 'ophthal' which derives from the Greek word ophthalmòs, meaning eye.
Thus the court considers that the distinguishing element in the later mark is the word CUSI, while OFTAL also associated with characteristics of the goods.
The argument of the trademark applicant that this mark is part of the family marks TIM OPHTAL, TIM OPHTAL, LAC OPHTAL was not adopted by the court which believes that the distinctive elements of these trademarks are just the words TIM, TIM, LAC.
