Изчерпване на авторски права в САЩ - важно съдебно решение - Exhaustion of copyrights in the U.S. - an important judgment

IP Kat съобщана новината за едно важно решение на Върховният съд в САЩ.
Става дума за съдебното дело Kirtsaeng v Wiley и концепцията за изчерпване на авторски права в САЩ.
Основният спорен момент в това дело е: може ли законно произведени книги в чужбина да се ползват от концепцията за изчерпване на права.
Ключовият момент тук е как се тълкува текста от закона 17 USC, section 109 (a) , който е:

"Notwithstanding the provisions of section 106(3), the owner of a particular copy or phonorecord lawfully made under this title, or any person authorized by such owner, is entitled, without the authority of the copyright owner, to sell or otherwise dispose of the possession of that copy or phonorecord."

Дали този текст определя, че изчерпването на права касае книги произведени само в САЩ или не.
Според решението на Върховният съд, закона не определя географски ограничения за това изчерпване на права.
Интересно решение, за разлика от САЩ обаче в Европа в концепцията за изчерпване на права винаги се споменава и териториалния й принцип. Например чл.18а от ЗАПСП.

IP Kat has reported the news about an important decision of the Supreme Court of the United States.
It concerns the lawsuit Kirtsaeng v Wiley and the concept of exhaustion of copyrights in the United States.
The main issue of this case is: Can legally produced books abroad to benefit from the concept of exhaustion of rights.
The key point here is how to interpret the text of the Act 17 USC, section 109 (a), which is:

"Notwithstanding the provisions of section 106 (3), the owner of a particular copy or phonorecord lawfully made under this title, or any person authorized by such owner, is entitled, without the authority of the copyright owner, to sell or otherwise dispose of the possession of that copy or phonorecord. "

Whether this text specifies that the exhaustion of rights concerns books produced in the U.S. or not. 
According to the decision of the Supreme Court, the law does not define any geographic limitations on exhaustion of rights. 
Interesting decision, unlike the U.S., however, in Europe the concept of exhaustion of rights always mentioning a territorial principle. For example, art. 18a of the Copyright Law in Bulgaria.
