GLISTEN не може да бъде европейска марка - GLISTEN can't be European mark

Европейският съд излезе с решение по дело  Case T- 648/13. То касае опит на IOIP Holdings LLC да регистрира европейска марка “GLISTEN” за стоките от клас 3 -
‘Cleaning preparations for dishwashers; cleaning preparations for washing machines; cleaning preparations for hot tubs and jetted bathtubs; cleaning preparations for microwave ovens; cleaning, freshening, deodorant and disinfectant preparations for garbage disposals’.
OHIM отказва регистрацията на марката на абсолютни основания. Английската дума ‘glisten’ означава "блестя", което би подсказало на потребителите характеристиките на конкретните стоки.
Заявителят посочва, че е получил регистрация за същата марка и същите стоки в САЩ но това не представлява довод при автономната система за регистрация на европейски марки.

The European Court ruled in case T- 648/13. It concerns an attempt of IOIP Holdings LLC to register an European trademark “GLISTEN” for the following goods in Class 3 - ‘Cleaning preparations for dishwashers; cleaning preparations for washing machines; cleaning preparations for hot tubs and jetted bathtubs; cleaning preparations for microwave ovens; cleaning, freshening, deodorant and disinfectant preparations for garbage disposals’.
OHIM refused the trademark registration based on absolute grounds. The English word  “GLISTEN” means shine and could be understood by the relevant consumers as descriptive term for above mentioned goods.
The applicant pointed out that he had already registered identical mark for these goods in US but this was irrelevant because of the autonomy of the Community trademark regime.
