Срещу тази марка е подадена опозиция от M. Raffaello Morelli и l’Associazione politica federazione dei liberali на основата на регистриран домейн “partitodellaliberta.it” с по-ранна дата.
OHIM отхвърля опозицията с довода, че само регистрацията на домейн не е достатъчно основание за успех на опозицията. Съдът потвърждава това решение.

The European Court has ruled in cases Cases T-321/11 and T-322/11.
They concern the attempt of Associazione nazionale circolo del popolo della libertà to register a following European trademark for classes 9, 14, 16, 24, 25, 35, 36, 38, 41, 42 and 45.

An opposition against this mark was filled by M.Raffaello Morelli and l'Associazione politica federazione dei liberali based on the domain name "partitodellaliberta.it" with an earlier priority.
OHIM rejected the opposition on the ground that only the registration of a domain is not sufficient for success of the opposition. The Court upheld this decision.
