Триизмерни марки в Швейцария- столът Panton ( Three-dimensional marks in Switzerland - Panton chair)

Froriep Renggli съобщава в публикация за International Law Office новини за развитието на казусът относно исканата регистрация на столът Panton, като триизмерна търговска марка в Швейцария.
Столът Panton е създаден от датският дизайнер Verner Panton през 1967 година, които използва за първи път материали, като пластмаса в неговото създаване, което придружено с новаторската форма превръщат този стол в едно от най-популярните дизайнерски решения за 20 век в областта.
Естествено впоследствие се правят опити за регистрацията на столът, като триизмерна търговска марка включително и в Швейцария.
Заявката обаче е отказана от The Federal Institute of Intellectual Property с доводите, че столът не притежава присъща отличителност поради, което не може да бъде търговска марка.
При обжалването The Federal Administrative Court постановява обратното, като допуска регистрацията на марката основавайки се на специфичната форма.
Следваща инстанция The Federal Supreme Court отхвърля решението на Административният съд. Според него решението дали определен обект е отличителен или не зависи от възприятието на средният добре информиран потребител. Върховният съд смята, че за да бъде регистриран, като триизмерна търговска марка един продукт трябва да притежава форма, която се различава значително от общо установените в съответната област защото обикновено потребителят счита формата на продуктът за елемент на дизайна и не толкова за източник на произход. В конкретният случай съдът смята, че има многообразие от форми отнасящи се до столове. Столът на Panton не притежава достатъчно различна форма, така че потребителите да го счетат за източник на произход, условие за да бъде регистриран, като марка.
The Federal Supreme Court връща делото към The Federal Administrative Court, които трябва да реши дали поради дългогодишното си използване столът Panton не е придобил вторична отличителност, което може да позволи неговата регистрация.

In this case, the court considers that there is diversity of forms relating to the chairs. Panton chair does not have a sufficiently different form, so that consumers consider it a source of origin, the condition to be registered as marks.
The Federal Supreme Court returned the case to The Federal Administrative Court, which must decide whether the Panton chair is acquired secondary distinctness because their continued use, which may allow registration.
