Европейската комисия подава искане за заличаване на марката на основание член 7(1) (h) от Регламент 207/2009, а именно наличие на знамето на ЕС в марката.
OHIM първоначално отхвърля заличаването поради липса на достатъчни доказателства, че потребителите ще асоциират стоките с институциите на ЕС.
Апелативният борд отменя това решение и заличава марката. Според Борда има достатъчно доказателства, като например Директива 2007/46 “Establishing a framework for the approval of motor vehicles and their trailers, and of systems, components and separate technical units intended for such vehicles” , която е основание при използване на такъв знак потребителите да го свържат с ЕС.

Welte-Wenu GmbH registered following European trademark for Classes 7 and 12.
The European Commission requested a cancellation of the mark under Article 7 (1) (h) of Regulation 207/2009, namely the presence of the EU flag in the mark.
OHIM rejected initially the cancellation for lack of sufficient evidences that consumers would associate the goods with the EU institutions.
The Board of Appeal annulled this decision and cancel the trademark. According to the Board there are sufficient evidences, such as Directive 2007/46 "Establishing a framework for the approval of motor vehicles and their trailers, and of systems, components and separate technical units intended for such vehicles", which create opportunities such a sign to be associated by consumers with the EU.
The Court upheld this decision of the Board of Appeal. According to the Court using a mark with the EU flag may mislead consumers that the goods under the mark meet the standards and requirements of the EU.
