LG подписа лицензионен договор с Microsoft свързан с патенти за Android и Chrome. LG използва Android в смарттелефоните си, според специалисти компанията се готви да стартира използване и на Chrome, което до момента не правеше.
Microsoft вече има 11 споразумения за лицензиране на патенти с HTC, Samsung и Acer.
Според предположения за 70% от продаваните смартелефони в САЩ има сключени лицензионни споразумения с Microsoft, който притежава огромен брой патенти за технологии в тази област.

LG has signed a license agreement with Microsoft for patents related to Android and Chrome. LG use Android in it's own smart phones, according to experts the company is preparing to use Chrome too, which has not made by that moment.
Microsoft now has 11 licensing agreements regarding patents with other rivals as HTC, Samsung and Acer.
According to the assumptions for 70% of smart phones which are sold in the U.S. there is signed licensing agreements with Microsoft which has an enormous number of patents for technologies in this field.

According to the decision of the European Court of Justice between two marks, similarity exists. The earlier mark may be perceived by the letter E or C (as deter from First BoA and the German Trademark and Patent Office).
The applied for CTM can be interpreted as an Е or as an abstract pattern. The outline of the pants’ pocket is a simple and banal geometric form and will not catch the consumer’s attention.
Accordingly, for part of the relevant public, there is a visual similarity, a phonetic similarity or dissimilarity and a neutral concept. Thus, there is a likelihood of confusion for the part of the public which interprets both signs as an Е.

Доказателства за използване на марка в Турция - Evidences for use of a mark in Turkey

Marques Class 46 съобщава за интересен случай за доказване на използване на търговска марка в Турция.
Случаят касае опит за заличаване на марка на една турска медийна компания поради неизползване в рамките на 5 години. Според компанията макар тя да няма разрешение за излъчване на радио и телевизионни програми в Турция, нейните програми за които се използва марката са излъчвани по интернет от сайт ситуиран извън страната. Значителен брой турски потребители са посещавали нейните online програми.
Според решението на Апелативния съд подобен вид използване на една търговска марка е достатъчно за да се счете, че тя е използвана реално на територията на Турция.

Marques Class 46 reported an interesting case concerning the proof of use of trademarks in Turkey.
The case concerns an attempt of canceling a mark of a Turkish broadcast company for non-use within 5 years. According to the company although it does not have permission to broadcast radio and TV programs in Turkey, its programs for which the mark has been used are broadcasted over the Internet from a site situated outside the country. A significant number of Turkish consumers are visiting its online programs.
According to the decision of the Court of Appeal this type of use of a trademark is sufficient to consider that it is actually used on the territory of Turkey.

Goodyear Dunlop загуби спор за марка на Общността - Goodyear Dunlop lost dispute concerning Community trademark

Европейският съд излезе с решение по спор между Goodyear Dunlop и Sportfive GmbH & Co. KG.
Goodyear заявява QUALIFIER, като европейска марка за клас 12 - автомобилни гуми. Sportfivе подава опозиция на базата на свои по-ранни марки QUALIFIERS 2006 и 2008 QUALIFIERS за същия клас и стока.
Според решението на съда макар гумите да не са масов продукт, тяхната покупка не изисква задълбочени познания, така че оценката касае средно информираният потребител.
Стоките и при двете марки са идентични. Самите марки са частично идентични, годините 2006 и 2008 в по-ранните марки биха се възприели, като години на производството.
Поради това съществува вероятност от объркване на потребителите.

Goodyear had filed an application for QUALIFIER as a Community trademark for Class 12 - tires. Sportfive filed opposition on the basis of its earlier marks QUALIFIERS 2006 and 2008 QUALIFIERS for the same class and good.
According to the Court even though the tires are not a mass consumption goods, the purchase itself does not require any deep knowledge, so that the evaluation concerns the average informed consumer.
The products for both marks are identical. The very names are partly identical, the years 2006 and 2008 in the earlier marks would be perceived as years of production.
Therefore, there is a likelihood of confusion of consumers.

ZATECKY GUS не може да бъде марка за бира в Русия - ZATECKY GUS can not be a mark for beer in Russia

Руското патентно ведомство наскоро отказа да регистрира марка ZATECKY GUS, заявена от най-голямата пивоварна в страната Baltika Breweries. Отказът е основан на абсолютни основания, тъй като ZATECKY е прилагателно произхождащо от думата ZATEC, град в Чехия известен със собствена бира под същото име. Поради това заявената марка може да въведе потребителите в заблуждение.
Засега не е известно дали пивоварната ще обжалва решението на ведомството. Baltika Breweries е част от Carlsberg Group и притежава 40% от пазара на бира в Русия.

The Russian Patent Office has recently refused to register a trade mark ZATECKY GUS, which was claimed by the largest brewery in the country Baltika Breweries. The refusal was based on absolute grounds as ZATECKY is an adjective derived from the word ZATEC, Czech town famous for its own beer under the same name. Therefore, the applied mark can mislead consumers.
It is not known whether the brewery will appeal the decision of the office. Baltika Breweries is part of the Carlsberg Group and owns 40% of the beer market in Russia.

Черна гора се присъедини към Споразумението от Виена - Montenegro acceded to the Vienna Agreement

WIPO оповести новината за присъединяването на Черна гора към Споразумението от Виена за международна класификация на фигуративни елементи на търговските марки.
Споразумението влиза в сила за страната от 9 март 2012.
