PINK can not be a trademark for wine - PINK не може да бъде марка зи вино


Португалската компания The Fladgate Partnership-Vinhos S.A. регистрира през 2008 година, европейска марка PINK за стока- вино.
В момента друга португалска компания Gran Cruz Porto, Sociedade Comercial de Vinhos, Lda подава искане за отмяна на регистрацията на марката на абсолютни основания. Според тях думата PINK е описателна за продукта вино, особено за виното розе.
Притежателят на марката подава искане до OHIM за ограничаване на стоките до определен вид вино, а именно портвайн. По този начин The Fladgate Partnership-Vinhos S.A. считат, че думата PINK не може да бъде счетена за описателна, тъй като портвайна е специфичен вид вино, в чието създаване се прибавя и бренди. Така думата pink не може да бъде счетена за описателна.
Според другата португалска компания това ограничение не решава въпроса защото портвайна е вид вино, освен това е й географско наименование.
В подкрепа на доводите си Gran Cruz Porto, Sociedade Comercial de Vinhos, Lda предоставят множество доказателства - извадки от речници, сайтове, публикации, решение на the Portuguese Industrial Property Institute (INPI) относно същия казус и тн.
OHIM излиза с решения за отмяна на регистрацията на марката. Ограничаването на марката до портвайн не може да преодолее факта, че става дума отново за вино, при което думата pink се счита за описателна.
Освен това OHIM посочва, че PINK е дума използвана често за осъществяване на връзка между ингредиенти състоящи се от вино, водка, ликьор и тн. в различни алкохолни напитки.

A Portuguese company The Fladgate Partnership-Vinhos SA registered an European trademark PINK for wine in 2008.
Currently another Portuguese company Gran Cruz Porto, Sociedade Comercial de Vinhos, Lda request for
invalidation of registration of that mark on absolute grounds. According to them the word PINK is descriptive of the product wine, especially wine, rosé.
The proprietor submitted a request to the OHIM to limit the goods to a particular type of wine, namely port wine. Thus, The Fladgate Partnership-Vinhos SA consider that the word PINK can not be regarded as descriptive as the port is a specific type of wine in whose creation is adding brandy. So the word pink can not be considered descriptive.
According to another Portuguese company that restriction does not solve the issue because the port is a type of wine, moreover, its geographical indications.
In support of its argument Gran Cruz Porto, Sociedade Comercial de Vinhos, Lda provide ample evidences - excerpts from dictionaries, websites, publications, decision of the Portuguese Industrial Property Institute (INPI) on the same case and so on.
OHIM issued a decision for invalidation of the registration of the mark. Restricting the mark to port can not overcome the fact that this is a type of wine, in which the word pink is considered to be descriptive.
Moreover, OHIM states that PINK is a word often used for linking ingredients consisting of wine, vodka, liqueur and so on. in various alcoholic beverages.

Geographical indications from Croatia will be recognized by the EU? - Географски означения от Хърватска ще бъдат признати от ЕС?


Както знаем към днешна дата Република Хърватска и Европейския съюз водят преговори за присъединяването на страната към Общността.
Една част от процедурата по присъединяване е свързана и с интелектуалната собственост, по специално тук става дума за географските означения.
Списък от 30 географски означения за вино и спиртни напитки от Хърватска са били подадени към Европейската комисия за съгласуване и одобрение. Целта е след това те да бъдат признати на територията на ЕС.
Списъкът може да бъде открит тук.
ЕК се обръща към всяка трета страна членка на ЕС или към отделно заинтересовано лице, за възражение срещу признаването на тези географски означения. Възражението трябва да бъде обосновано и подкрепено с ясно посочени твърдения и претенции.
Европейската комисия предоставя срок от 2 месеца за подаване на възражения, които могат да бъдат пращани на този адрес - AGRI-B2@ec.europa.eu
Разглеждайки списъкът с посочени означения за вина и спиртни напитки, две от тях правят впечатление тъй като имат лека прилика с географско наименование в България- Dalmatinska zagora ( за думата Загора) и Zagorje – Međimurje ( също за думата Загора).

As we know the Republic of Croatia and the European Union negotiate for accession of the country to the Community.
One part of the accession procedure is associated with intellectual property, particularly here it refer to geographical indications.
A list of 30 geographical indications for wine and spirits from Croatia have been submitted to the European Commission for coordination and approval. The aim is after that they can be recognized within the EU.
The list can be found here.
The Commission invites any third Member State or a single interested party to object to the recognition of these geographical indications if there are any reasons for that. The objection must be justified and supported by clearly stated assertions and claims.
The European Commission provides a period of two months to lodge objections that can be sent to this address - AGRI-B2@ec.europa.eu
Looking down the list of indications for wines and spirits, two of them made an impression because they have a slight resemblance to the geographical name in Bulgaria - Dalmatinska zagora (about the word Zagora) and Zagorje - Međimurje (also about the word Zagorje).

A Bulgarian trademark TCHERGA in Poland - Българска марка Черга в Полша


Marques Class 46 съобщава новината за интересен случай относно регистрацията на марка TCHERGA в Полша.
Компанията DOMAIN MENADA Sp. z o.o. заявява марка TCHERGA – ŻYJ KOLOROWO" за клас 33 в Полша. Патентното ведомство на Полша отказва да регистрира марката поради наличието на по-ранна марка Tcherga регистрирана от BELVEDERE Capital Management.
DOMAIN MENADA посочва че тя е компания, която е свързана с българската компания BELVEDERE и че има писмо за съгласие относно регистрацията на марката. Освен това те припомнят, че вече имат една регистрирана марка по този начин - TCHERGA CRAZY FOR COLOUR.
Патентното ведомство потвърждава отказът тъй като според полското законодателство свързаността на компаниите не е основание за допускане на регистрация на идентични или сходни марки за идентични или сходни класове.
Писмото за съгласие като опция се допуска в силно ограничени случай на регистрация на идентични марки за идентични стоки, като обаче по-ранната марка се прекратява.
С една дума не се допуска две компании да притежават еднакви марки.
Посочената от DOMAIN MENADA регистрация на марка с писмо за съгласие е станала преди Върховният съд да се произнесе, че тази практика е неправилна съобразно полското законодателство.

Marques Class 46 reported news of an interesting case concerning the registration of a mark TCHERGA in Poland.
DOMAIN MENADA Sp. z oo filed application for trademark TCHERGA - ŻYJ KOLOROWO "for Class 33 in Poland.
Poland's Patent Office refused to register the mark because of the existence of an earlier mark
Tcherga registered by BELVEDERE Capital Management.
DOMAIN MENADA indicate that it is a company that is associated with the Bulgarian company BELVEDERE and that there is a letter of consent on the registration of that mark. Furthermore, they recall that they have already had a registered trade mark - TCHERGA CRAZY FOR COLOUR by this way.
The Patent Office confirmed the refusal because according to Polish law the connectivity of the companies is not a reason for allowing the registration of identical or similar marks for identical or similar classes.
The letter of consent as an option is allowed in very limited cases of registration of identical marks for identical goods, however, the earlier mark is terminated.
In one word it is not allow two companies to own same trademarks.
The mark which has already been registered with a letter of consent occurred before the Supreme Court to rule that this practice is improper under Polish law.
Anyone who wants to protect its brand in Poland should consider the above.

The 3rd Global IP Index - Глобален IP индекс за 2011 година


The Taylor Wessing Global Intellectual Property Index обявиха началото на определянето на третия поред годишен глобален IP индекс.
Целта на индекса е да определи развитието на интелектуалната собственост по света и свързаното с нея законодателство.
Всеки който иска може да попълни въпросникът за определяне на този индекс може да участва тук. Не е задължително да се посочва име на попълващият информацията.
Предоставена е възможност да се избират всички или само едни от обектите на интелектуална собственост за които да се дават отговори.

The Taylor Wessing Global Intellectual Property Index announced the beginning of the appointment of the third consecutive annual global IP index.
The purpose of the index is to determine the development of intellectual property worldwide and related legislation.
Anyone who wants to complete a questionnaire to determine this index can be involved here. It is not necessarily to submit a name.
It is given an opportunity to choose all or just some of the objects of intellectual property for which answers are given.

An accelerated registration of patents in the U.S. - Ускорено регистриране на патенти в САЩ


Патентното ведомство на САЩ обяви намерението си да предостави възможност за максимално ускорено разглеждане на заявки за патенти срещу заплащане на допълнителна такса в размер на 4000 долара.
Целта е по този начин една заявка за патент да бъде разглеждане в период от 12 месеца.
Това ново предложение не замества съществуващите към момента възможности за ускоряване на една заявка при определени ситуации.
Чрез него обаче един заявител може да заобиколи изискванията залегнали, като условия за обикновенното ускоряване на една заявка.
Искане за такава бърза процедура на експертиза може да бъде подадено само от нови заявители.

U.S. Patent Office announced its intention to provide maximum opportunity for accelerated examination of patent applications in case of payment of additional fee of 4000 dollars.
The aim is by this way, a patent application to be considered in a period of 12 months.
This new proposal does not replace currently existing opportunities to accelerate one application under certain situations.
It, however, an applicant can circumvent the requirements set out as conditions for the usual
acceleration.
A request for such a rapid procedure of an examination may be submitted only by new applicants.

A world register of geographical indications relating to wines and spirits - Световен регистър за географски означения касаещи вина и спиртни напитки


OHIM обяви на своя интернет сайт новината за стартиралата работа по създаване на световен регистър включващ географски означения касаещи вина и спиртни напитки.
Регистърът се създава от Световната търговска организация. Основните теми дискутирани по отношение на същността на този регистър са: създаване на система от термини, как ще функционира системата за регистрация и каква ще бъде ролята на СТО, дали участието на държавите членки на СТО ще бъде задължително или не, какво ще произхожда от самата регистрация, като последица, специално третиране на развиващите се държави, такси и разходи.

OHIM announced on its website the news about the start of work on creating a global registry including geographical indications relating to wines and spirits.
The register shall be established by the World Trade Organization. Some of main topics discussed on the substance of this registry are:
the legal basis of the terms that members would notify; how the registration system would be run; the legal consequences of registration; fees and costs; the treatment of developing countries; and the terms of participation, including whether taking part would be voluntary or compulsory.
